Introduction
WeSeeYu, owned and operated by Gryphon Fundraising Inc. (the “Company”) is a Company that provides technology solutions and a software application to help patients (and/or their spouses/legal guardians/powers of attorney/next of kin) explain for themselves who they are, what they need and how they would like to be cared for by health care professionals. The Company also provides technology solutions such as the ability to monitor health metrics and share same with their spouses/powers of attorney/family care givers/ other family members, communicate in real time with loved ones, and other technology solutions aimed at increasing a patient’s overall well-being.
This Privacy Policy summarizes what personal information and personal health information we collect and how we use and/or disclose this information when you use our website WeSeeYu.com (the “Site”) and our WeSeeYu Software Application (the “App”) and any of our related subscription services (the “Related Services”). We assure you that the personal information and personal health information we collect will be used in an appropriate and responsible manner. We are committed to protecting the privacy of all personal information and personal health information that you voluntarily share with us, and we will manage it in accordance with the applicable Canadian privacy legislation and any other applicable provincial and federal legislation.
By visiting our Site, you signify your consent to the terms of our Privacy Policy. If you do not agree with any terms of this Privacy Policy, please do not use the Site. When using our App and Related Services, you will be required to signify your express consent to the terms of our Privacy Policy before you submit any of your Personal Information or Personal Health Information or any Personal Information or Personal Health Information you submit on behalf of a patient in care who is incapable of submitting said information themselves. This Privacy Policy also describes certain choices you have regarding how we use your personal information and your personal health information.

We suggest that you periodically consult this Privacy Policy. What is Personal Information and Personal Health Information and How We Collect It

We collect this information through the App and Related Services, and you determine which type of Personal Health Information you wish to voluntarily upload to the App and Related Services, which may include:

any other Personal Health Information that you voluntarily choose to upload to the App or any Related Services.
WeSeeYu allows for the storage and sharing of Personal Information and Personal Health Information by the patient or the patient’s spouse/legal guardians/powers of attorney/next of kin, for their sole and exclusive use. This Privacy Policy is not about the collection, use and/or disclosure of Personal Information or Personal Health Information by healthcare providers or health information custodians and at no time should WeSeeYu be deemed to be a Consumer Electronic Service Provider or any other type of technology solution to enable the sharing of Personal Information or Personal Health Information as between healthcare professionals/providers or health information custodians.
When you visit our Site, we may collect information that is automatically sent to us by your web browser. This information may include:
your domain name; and
your numerical IP address.
We may also collect other information, such as the type of browser you use, which pages you view, and the files you request. We use this information to:
better understand how visitors use our Site; and
to improve our Site to better meet your needs.

The Personal Information and Personal Health Information we collect may be used for the purposes for which it was collected, as provided in this Privacy Policy, or for other purposes that are disclosed to you and to which you expressly consent. For example, we may use your Personal Information and Personal Health Information to:

supply you with requested products or services as outlined on our Site such as personalized AI-generated videos of patients and optional daily health monitoring to track vitals and alert a patient’s loved ones;
To manage your account and provide you with customer support;

How We Share Personal Information and Personal Health Information
When using our App for the purpose of generating a personalized AI-generated video, we transfer the Personal Information and Personal Health Information you voluntarily share with us and which you would like included in your video, to a third party service provider, HeyGen, for the sole purpose of creating the AI-generated videos. HeyGen is based in the United States, and it has its own privacy policy which outlines how they handle the content, information and data that we upload to them. For more information, please visit their privacy policy page at www.heygen.com. Additionally, while utilizing our App and Related Services, such as the optional daily health monitoring to track vitals, in conjunction with your Apple iPhone or other Apple products, Personal Information and Personal Health Information may be transferred to Apple and/or other Apple providers that assist with carrying out these purposes for you. All data related to the optional daily health vitals monitoring is collected and stored through the Apple Health App as provided by Apple on all Apple iPhone products including mobile devices, iPads and iWatches.
We do not sell or share your information with third parties, except as necessary for the operation of the features of the App and Related Services as noted above, or as required by law. The Company reserves the right to transfer Personal Information and Personal Health Information in the event that we merge with or are acquired by a third party. We also may disclose your Personal Information for any other purpose required or permitted by law or to which you consent.
How We Protect Personal Information and Personal Health Information
The security of your Personal Information and Personal Health Information is important to us. We help protect your Personal Information and Personal Health Information in our custody and control by maintaining physical, organizational and technological safeguards. Personal Information may be accessed by persons within our organization who require such access to carry out the purposes described in this Privacy Policy, or such other purposes as permitted or required by law. The Personal Information and Personal Health Information we collect is maintained by the Company in Canada, with the source of the information in Ottawa, Canada. That said, we remind you that when using our App for the purpose of generating a personalized AI-generated video, we transfer the Personal Information and Personal Health Information you voluntarily share with us and which you would like included in your video, to a third party service provider, HeyGen, for the sole purpose of creating the AI-generated videos. HeyGen is based in the United States, and it has its own privacy policy which outlines how they handle the content, information and data that we upload to them. As a result, this information may be subject to access requests from governments, courts or law enforcement in those jurisdictions according to laws in those jurisdictions. Once video creation is complete, all images and videos that were uploaded to this third party (HeyGen) are deleted and those images and videos are downloaded to our secure Dropbox folder for storage and processing. Dropbox is a third party company that provides the ability to store large amounts of data. As a result, this information may be subject to access requests from governments, courts or law enforcement in those jurisdictions according to laws in those jurisdictions. Dropbox has their own privacy policy which can be found at the following web address https://www.dropbox.com/privacy?_tk=learning_center. Images and videos stored on our Dropbox folder will remain only so long as your subscription is active. Within ten days of unsubscribing from our app all images and videos pertaining to your account will be deleted from our Dropbox folder. We retain Personal Information and Personal Health Information that we collect only as long as your account is active, and only as long as it is necessary for the purposes for which it was collected or to meet legal requirements. We destroy Personal Information and Personal Health Information, all images and videos on our servers when it is no longer needed for such purposes or within ten days of when you end your subscription. It is important to understand that no security measures are absolute. We cannot guarantee the safety of any information you provide to us so we encourage you to think carefully about any personal information you may be sharing and err on the side of caution.
